Abstract

The Foreign Surveillance Team (TIMPORA) carries out surveillance and investigation of foreigners holders of a limited residence permit (ITAS) in the Bangka Island Water Production Ship (KIP) in accordance with their respective authority. In its implementation still found the sectoral ego of each agency so making the performance of TIMPORA is not optimal and effective. The objective of this article is to examine the extent to which the division of authority in the implementation of the oversight policy and the reformulation of the Foreign Labour Surveillance policy by TIMPORA members at the level of the Province of the Arlington Islands. Yuridic-empirical law research methodology with a structural approach that tests the theory of law and compares facts in the field through direct observation and interview with the source. The results of this study show that TIMPORA's current authority-sharing implications have been appropriate and are running well. However, there is an element of weakening of the powers of the Employment Supervisor at the district/city level in Government Regulation No. 34 of 2021 on the Use of Foreign Labour Article 35 (1) letter a which only grants the authority of the oversight of foreign labour to the overseer of employment at the provincial level. The optimization of the legitimacy and independence of the Employment Supervisor can be achieved by reconstructing the institutional structure of the Ministry of Labour into a vertical agency.
